Debian takes a reactive approach, that is to say they only remove code 
when legal action is directly threatened. Unfortunately this leaves the 
project open to claims for retrospective damages which could easily run 
into millions of dollars (number of Debian downloads multiplied by the 
fine).

I think there's a perception that Debian is safe from legal action 
because it's represented by a not-for-profit, SPI, but I don't see any 
evidence for that view. Also, there's the perception that Debian isn't 
worth suing because it doesn't have any money (compared to say, Red Hat, 
which has around US $1 billion in cash reserves from its IPO). However, 
Debian is backed by and distributed by many large, well-funded 
companies, so I don't think the project should be complacent there either.

Just my outsiders view, I am not a lawyer, blah blah blah :-)
